These Terms and Conditions have been drawn up in accordance with the Slovenian Consumer Protection Act (ZVPot), the Slovenian Personal Data Protection Act (ZVOP-1) and the Slovenian Electronic Communications Act (ZEKom-1), based on the recommendations of the Chamber of Commerce and Industry of Slovenia and international codes for online and electronic commerce.
These Terms and Conditions regulate the operation of the online store www.oldtimer-shop.eu (hereinafter: the “online store”), operated by MAS d.o.o., Partizanska cesta 82, 6210 Sežana, +38631635729, [email protected], VAT ID No.: SI16635876, a company entered in the Business Register of Slovenia under registration number 2138298000 (hereinafter: the “merchant”), as well as the rights and obligations of the provider and visitors of the online store and of users who make a purchase via the online store (hereinafter: the “customer”).
These Terms and Conditions define the operation of the online store, the rights and obligations of users and the online store, and regulate the business relationship between the merchant and the customer.
The customer is bound by the Terms and Conditions that are in force at the time of purchase (submission of the online order). Each time an order is placed, the customer is specifically informed of the Terms and Conditions and by submitting the order confirms that they have been familiarized with them.
The merchant undertakes that the customer will always have access to:
Due to the nature of online business, the product offer in the online store changes and is updated frequently and quickly, and therefore errors may also occur. In order to correct errors as quickly as possible, the merchant asks the customer to notify the merchant of any errors via the form or telephone number published on the website.
The sales contract between the merchant and the customer is concluded in the merchant’s online store at the moment when the merchant sends the customer the first e-mail message regarding the status of their order (with the subject: confirmation of receipt of order). From that moment, all prices and other conditions are fixed and apply both to the merchant and to the customer. This e-mail message is not a confirmation that the goods are in stock or that shipment has begun, but only a notification to the customer that the merchant has received the order and that the procedure of checking the availability of the goods has started. The customer is the person whose data are stated when the order is placed. Subsequent changes to customer data are not possible.
The sales contract (i.e., the first e-mail message regarding order status) is stored in electronic form on the merchant’s server.
After checking availability, the merchant sends the customer an order confirmation with a link in the e-mail including information on the delivery time and execution. The sales contract between the merchant and the customer is concluded at the moment when the merchant sends online confirmation of the order by the customer. Within the agreed period, the merchant prepares the ordered products, dispatches them and notifies the customer thereof by e-mail. In the e-mail message, the merchant also informs the customer of the product return policy and provides contact persons in case of complaint or delivery delay. The text of the concluded sales contract is stored in electronic form and is accessible to the consumer via the order confirmation e-mail received after placing the order.
After delivery of the ordered items, the merchant also sends the customer an invoice, in PDF format to the customer’s e-mail address, or a printed invoice is enclosed with the delivered items. In the case of personal collection at the collection point, the customer receives a printed invoice for the purchased items upon collection.
The invoice specifies the price and all costs related to the purchase and includes a notice of the right to withdraw from the contract.
The customer is obliged to check the correctness of the data before placing the order. Objections submitted later regarding the correctness of issued invoices are not considered.
Purchase in the online store takes place in the following steps:
Contractual partners for delivery of shipments are: Pošta Slovenije, DPD, GLS, FedEx, DHL; however, the merchant reserves the right to choose another delivery service if this enables more efficient fulfillment of the order.
The customer or addressee is obliged to check the quantity and quality of the goods upon receipt. The customer expressly undertakes that, due to later delivery of the goods or a different delivery method, they waive other ways of reimbursement of incurred costs, paid purchase price and paid delivery costs, such as compensation claims in the form of civil lawsuits and similar, while retaining all other minimum rights in accordance with the provisions of Articles 23 and 24 of the Slovenian Consumer Protection Act (ZVPot).
The delivery time for products in stock is 5 to 10 working days, depending on the delivery address or the delivery country. The approximate delivery time is stated for each product or in the cart when placing the order in the online store. All products from the online store are available to customers within a reasonable time, except in cases where the delivery service does not provide delivery, which is expressly stated for the product or in the cart. The merchant does not dispatch goods on Saturdays, Sundays and public holidays.
The online price applies to all registered users of the merchant’s online store who have entrusted their data to the merchant. You become a registered user by registering in the online store as a member of the online store or by a one-time entry into the online store as a guest of the merchant’s online store.
All prices in the online store are stated in euros and include VAT, unless expressly stated otherwise. If an order is delivered outside EU countries, VAT is automatically deducted in the cart after entering the address. A promotional price is a reduced regular price at which the presented product is sold for a definite or indefinite time. Prices apply at the time of placing the order and have no predetermined validity period. Wholesale prices in the online store do not include VAT, or this is expressly stated. All prices in the online store are product prices and do not include delivery costs. All prices apply only to electronic ordering of products via the online store. Prices apply when paying with the payment methods listed below.
All prices apply at the time the order is placed and have no predetermined validity period, therefore they apply only until each change thereof. Despite the merchant’s efforts to ensure the most up-to-date and accurate information, it may happen that a price is incorrect. In the case from the previous sentence and in the case where the product price changes during order processing, i.e., from the moment the order is placed until the order is confirmed, the merchant will: a) inform the customer and notify them of the new prices, and in such case the customer may change the order, partially or fully cancel it, or confirm the order at the new prices, all without additional costs; and b) enable the customer to withdraw from the purchase and at the same time offer a solution that will be for mutual benefit and satisfaction.
The merchant enables the customer the following payment methods for purchasing products from the online store:
Payment by payment or credit card is possible only if the payer data in the customer profile are the same as the data in the customer profile for the holder of the payment or credit card.
In the case of payment by credit card online, in the event of order cancellation or a change of payment method by the customer, the customer must notify the merchant by e-mail in order to credit the card or refund the purchase price.
Products have a warranty if this is stated on the invoice or the warranty certificate. The warranty is valid subject to compliance with the instructions and conditions stated on the warranty certificate and upon presentation of the invoice. The warranty period is stated on the warranty certificate or on the invoice. Warranty information is also stated in the presentation of the product in the online store. If there is no warranty information in the online store, then the product has no warranty. In that case, the customer may contact the merchant, who will provide up-to-date information. The customer may exercise the warranty with the merchant or directly with the manufacturer of the product or its authorized service. The customer may exercise the warranty with the warranty certificate and invoice. The manufacturer or its authorized service must carry out warranty repairs within 45 days from the day of receipt of the product for repair, otherwise the product must be replaced with another equivalent product in flawless condition.
The customer has the right, within 15 days from the day of receipt of the ordered products, to notify the merchant at the published e-mail address that they withdraw from the sales contract, without having to state the reason for such decision. The return of the purchased products to the merchant within the withdrawal period is considered as notification of withdrawal. The only cost borne by the customer due to withdrawal from the sales contract is the cost of returning the products to the merchant. For this purpose, the consumer may optionally use the attached sample withdrawal form – available at the link below.
ATTACH FORM
The deadline for returning purchased products is 14 days from the day the notification of withdrawal from the sales contract is sent. Returned products must be undamaged, in original packaging and in unchanged quantity, unless the products are destroyed, damaged, lost or their quantity has decreased without the customer being at fault. In the event that an error caused unjustified costs for the customer, the merchant will attempt to reimburse them no later than within 14 days of a reasoned notice with an explanation of the error. The merchant carefully packs all products in a delivery box before shipping. All products are undamaged before packaging, thoroughly inspected and in original packaging.
For returned products, the merchant returns to the customer, no later than within 14 days from receipt of the withdrawal notification, the paid amount or credit on a gift voucher; any used promotional codes and other discounts are not returned to the customer. The paid amount is considered the total value of the returned products, including delivery costs (except additional costs due to the choice of a type of delivery that is not the cheapest offered standard delivery form by the company). The merchant refunds the paid amount using the same payment instrument as used for the original transaction, unless expressly agreed otherwise. A used gift voucher is returned by the merchant in the form of a credit note. Cash refunds are not possible. The merchant continuously strives for flawless changes on the website; nevertheless, an error may sometimes occur, and the merchant undertakes to remedy it as soon as possible once discovered. The customer may alert the merchant to an error by phone call or e-mail.
In the event of withdrawal from the contract, the customer returns the received item either by mail to the merchant’s address or brings it personally to the merchant’s collection point. The return of received items to the company within the withdrawal period is considered as notification of withdrawal from the contract.
The customer must not use the items without restriction until withdrawal from the contract. The customer may inspect and test the items only to the extent necessary to determine the actual condition. The customer is liable for any decrease in the value of the goods if the decrease results from handling that is not necessary to establish the nature, characteristics and functioning of the goods.
The customer has no right to withdraw from the contract for contracts whose subject is an item made according to the customer’s precise instructions, adapted to their personal needs, which by its nature is not suitable for return, which is perishable or has already expired.
In exceptional cases, when items are not returned in accordance with the Slovenian Consumer Protection Act (ZVPot), the merchant may offer the customer to buy back the item for appropriate compensation determined by the merchant by record upon return. The buy-back at reduced value is taken into account upon the customer’s confirmation by e-mail. The customer may use the said compensation exclusively when ordering another item of the same or higher value.
The right to a refund of the purchase price in the event of exercising the warranty and material defects is regulated in more detail by the provisions of the Slovenian Consumer Protection Act (ZVPot).
If the consumer decides to withdraw from the contract for items that form a set, the consumer may request replacement of the entire set with an identical set or a refund of the purchase price. The consumer may replace an item from the set in the case of a material defect or damage to the item, but may not request a refund of the purchase price for it. In the event of exercising the warranty for an item from the set, the manufacturer’s warranty period applies.
The customer is obliged to collect an item that they have delivered to the merchant for warranty or other processing after the processing has been completed. The customer collects the item at the collection point where they personally delivered it to the merchant; if it was sent by mail, it will be returned to the delivery address. The merchant sends the customer a notice of the return of the item from processing and invites them to collect the item. The customer must collect the item within 14 days from the day of the notice.
If the customer does not collect the item within the specified period, the item is handed over for storage to the merchant at the address of its warehouse. The merchant stores the item in its own warehouse until the expiry of 6 months from the day of the notice. For this period, the merchant is entitled to reimbursement of all storage costs and reimbursement of all costs necessary for preservation of the item.
After the expiry of 6 months from the day of the notice, the merchant may sell the item via its online store and transfer the achieved purchase price, after deduction of sales and other seller’s costs, to the customer. If the value of the item is negligible, the merchant may donate it for charitable purposes and in such case is not obliged to make any refund to the customer. The merchant informs the customer 15 days before the expiry of the 6-month storage period of the intended sale or donation of the item, and after the sale also of the achieved price and the amount of costs and the transfer of the remaining purchase price to the customer’s transaction account.
The merchant uses appropriate technological and organizational measures to protect the transmission and storage of personal data and payments. For these purposes, it uses a 128-bit SSL certificate issued by an authorized organization.
Credit card authorizations are carried out in real time with immediate verification of data with banks. Card data are not stored on the merchant’s server. The user is also responsible for security by ensuring the security of their username and password and appropriate software and antivirus protection of their computer.
The merchant does not accept orders in the online store from someone whom it knows or suspects to be a child without having the express permission of their parents or guardians. The merchant does not offer free access in the online store to products or services that are harmful to children. Without the express permission of parents or guardians, the merchant will not accept any personal data relating to children, nor will it disclose data received from children to third parties, except to parents or guardians. Any communication intended for children will be appropriate to their age and will not exploit children’s trust, lack of experience or sense of loyalty.
The merchant will contact the user via means of distance communication only if the user does not expressly object, and in accordance with the provisions of the Slovenian Electronic Communications Act (ZEKom-1). Advertising e-mails from the merchant will contain the following components: they will be transparently and unambiguously marked as advertising messages; the sender – the merchant – will be clearly identifiable; various actions, promotions and other marketing techniques will be marked as such. The conditions of participation in them will also be clearly defined; the method of unsubscribing from receiving advertising messages will be clearly presented; the merchant will expressly respect the user’s wish not to receive advertising messages. Advertising messages of the merchant will be clearly visible and clearly separated from games and competitions.
The merchant complies with applicable consumer protection regulations and has an effective complaint handling system and a designated person whom the customer can contact by telephone or e-mail in case of problems. The customer may submit a complaint to the merchant’s e-mail address. The complaint handling procedure is confidential. Within 5 working days, the merchant will confirm receipt of the complaint and inform the customer how long it will be handled, and will keep the customer informed of the progress throughout. The merchant will use its best efforts to resolve any disputes amicably. If an amicable settlement is not reached, the competent local court shall have jurisdiction for resolving all disputes between the merchant and the customer. The merchant and the customer, as participants in electronic commerce, mutually recognize the validity of electronic messages in court.
Slovenian substantive and procedural law applies to these Terms and Conditions and to all disputes between the merchant and the customer, and the rules of private international law that would refer to the application of any other law shall not apply. For all relationships and for rights and obligations not regulated by these Terms and Conditions, the provisions of the Obligations Code, the Electronic Commerce Market Act, the Personal Data Protection Act and the Consumer Protection Act apply accordingly.
The merchant publishes on its website an electronic link to the Online Dispute Resolution platform (ODR), available at: Online Dispute Resolution (ODR).
This arrangement is based on the Act on Out-of-Court Settlement of Consumer Disputes, Regulation (EU) No 524/2013 of the European Parliament and of the Council on online dispute resolution for consumer disputes and the amendment of Regulation (EC) No 2016/2004 and Directive 2009/22/EC.
The merchant is not responsible for consequences of using products purchased in the online store that arise from use not in accordance with the instructions for use of these products. All content on the merchant’s website is for informational purposes and serves only as a source of general information and cannot replace consultation with an expert.
The merchant is not responsible for disruptions in the performance of the service that are the result of actions of the customer or providers of routes or infrastructure used by the online store service. The merchant operates in accordance with applicable legislation and at all times takes care of customers. In possible disputes, it strives for an amicable solution. Any complaint may be addressed by the customer to the published contacts.
The merchant continuously strives to provide appropriate visual material, product descriptions and instructions. The customer or user must read and follow the instructions enclosed with a specific product before use. Customers may at any time alert the merchant to possible errors.
A defect is material when:
The suitability of the item is verified by comparing it with another flawless item of the same type, and also with the manufacturer’s statements or indications on the item itself.
The customer must notify the merchant of any material defect together with an accurate description within the legally prescribed period and at the same time enable the merchant to inspect the item.
The right to claim a material defect or non-conformity of goods is regulated in more detail by the provisions of the Consumer Protection Act: Consumer Protection Act (PisRS).
The merchant bears liability for any material defect or non-conformity of goods under the Consumer Protection Act, also in the event that it becomes apparent within two years from the delivery of the goods.
In the event of changes in regulations governing the operation of online stores, data protection and other areas related to the operation of the merchant’s online store, and in the event of changes in its own business policy, the merchant may amend and/or supplement the Terms and Conditions and will each time inform users in an appropriate manner. Each amendment or supplement to the Terms and Conditions becomes effective and is applied after the expiry of an 8-day period from publication of the amendments and/or supplements. If an amendment and/or supplement is necessary for compliance with regulations, exceptionally such amendments and/or supplements may become effective and applicable within a shorter period.
A customer who does not agree with the amendments and/or supplements must cancel their registration within 8 days from publication of the notice of the amendment and/or supplement; otherwise, after expiry of this period it is deemed, and proof to the contrary is not permitted, that the user accepts the amendments and/or supplements. Registration is cancelled by the customer notifying the merchant of the cancellation by written statement.
The merchant operates in accordance with the Electronic Commerce Market Act (ZEPT) and the regulations adopted on its basis.
The Terms and Conditions were adopted by the representative of MAS d.o.o., Tina Mevla, in Sežana, on 24.12.2025.
